When you resign or are terminated in India, you're entitled to a Full and Final (F&F) settlement — all dues from your employer. Understanding what's included, what's deducted, and what the legal timeline is protects you from being shortchanged.

  • TDS: On all taxable components

Leave Encashment: How It's Calculated

Leave Encashment = (Basic/26 × Pending EL days) OR (Basic/30 × Pending EL days) — varies by company policy.

Tax exemption: Under Section 10(10AA), leave encashment at retirement/separation is exempt up to ₹25 lakh for private sector employees (increased in Budget 2023 from ₹3L).

Legal Timeline for F&F Settlement

There's no single national law specifying F&F settlement timelines. But:

  • Most states: 45–60 days after last working day is considered reasonable
  • Gratuity: Must be paid within 30 days of separation under the Gratuity Act
  • Payment of Wages Act: Wages must be paid within 7 working days for payroll (if applicable)

What To Do When Employer Delays F&F

  1. Send a written email to HR requesting F&F within 30 days, citing specific components due
  2. Escalate to RD (Regional Director) of the Labour Department of your state
  3. For gratuity specifically: File a claim with the Controlling Authority under Section 7 of Gratuity Act
  4. EPFO grievance: If employer delays PF transfer, raise an EPF grievance at epfigms.gov.in
  5. Legal recourse: Civil suit for recovery of dues if employer is unresponsive
